The EU has come up with the EU AI Act, a proposal from the European Commission to regulate AI. The proposal describes credit assessment and risk management systems as high-risk AI

This implies that heavy regulations will be implemented for AI-based credit and loan processing systems. AI and ML systems can present a high risk of discrimination, and the European Commission understands that AI can be biased and therefore discriminate against certain categories of people.

Compliance deadlines for AI regulations are phased as follows: 

  • Within 6 months of the regulation's entry into force, the use of AI posing unacceptable risks is prohibited. 
  • By the 9-month mark, codes of practice for General Purpose AI must be finalized. The first year concludes with the application of these rules, the appointment of competent authorities by member states, and the possibility of an annual review and amendments by the Commission. 
  • At 18 months, the Commission will issue a template for high-risk AI providers' post-market monitoring plans. 
  • By the 24-month deadline, obligations for high-risk AI systems listed in Annex III come into effect, alongside enforcement of penalty rules by member states and the establishment of at least one operational AI regulatory sandbox per state. Additionally, a review of the high-risk AI systems list may be conducted. 
  • The 36-month mark sees obligations enforced for high-risk AI systems not included in Annex III but used as safety components or products requiring EU conformity assessments, such as toys and medical devices. 
  • Finally, by the end of 2030, obligations will be implemented for AI systems that are components of large-scale EU IT systems related to areas of freedom, security, and justice, such as the Schengen Information System.

While the EU AI Act has been one of the most highly publicized regulations, there are others, like the Algorithm Accountability Act in the U.S., the Personal Data Protection Bill in India, and the AI Guidelines in Canada.
